Recently I chipped my tooth eating a chicken wing in downtown San Jose Del Cabo.  The next day I called my long-time dentist Dr. Rosa Pena.  First I had to find her number since I had recently lost my cell phone, so I googled her clinic name for her contact information.  I was shocked at what came up on my search: “Dr. Rosa Pena wanted for arrest.  Cabo doctor wanted for fraud.  Angels Touch dental clinic ruined my implant procedure.  Rosa Pena caught doing unqualified procedures.”  The list went on and on as did testimonials backing up these allegations.  There was even a copy of her arrest warrant.  My first thought was for Rosa, as I have often seen her around town at events and she is always a kind and friendly person to chat with and these allegations did not seem in character with the Rosa I know.

Upon visiting her office at Plaza Dorado I talked with Enrique Ilitzky and Dr. Pena’s son Eduardo.  Dr. Pena was busy, as usual, attending to a client.  First, I was relieved to hear that Rosa is not in jail, nor has there been an arrest warrant issued for her.  It was explained to me that all the postings on the internet were from David Mandich, Dr. Penas ex-husband.  On December 6, 2010, David Mandich, along with Cabo San Lucas dentist Dr. Ramirez Cabañas, were arrested in Los Cabos for fraud after they used Dr. Pena’s clinic name and images to attract clients, unbeknownst to Dr. Pena.  After being freed from jail awaiting trial, Mandich escaped from Mexico and his current whereabouts are unknown.  In spite, he has waged an aggressive internet campaign to discredit Dr. Pena and her clinic.  Below is a recent example of this, a blog that was posted by the name Bartik on January 5^th of this year, 2012.  Again, the allegations in this blog post are untrue.

If you have seen any of the news recently about Dr. Rosa Pena, a local dentist here in Los Cabos, having an arrest warrant issued for her, do not be fooled.  This is a scam.  There has been no arrest warrant and she has the papers to prove it.  Dr. Rosa Pena and her dental clinic have been targeted by known fraudster David Mandich.

An arrest warrant, for real this time, was put out for David Mandich  on December 16, 2010 in Los Cabos for fraud due to his actions taken against Dr. Rosa Pena and her dental clinic.  Mandich had been, and is still currently, illegally using Dr. Rosa Pena’s name and clinic name to advertise and attract his own clients which he then sent to a different dentist in Cabo San Lucas named  Dr. Ramirez Cabañas.  Dr. Cabanas was also arrested for fraud for these actions.

How did all this come about?  It appears that hell hath no fury like an ex husband scorned, even if that husband is a fraudulent scam artist.  David Mandich was originally a patient of Dr. Pena.  After a time they became married.  Upon seeing her profitable business he apparently began scheming to take advantage of the situation.  The marriage did not last and after separation Mandich stepped up his plan to profit from Dr. Pena’s business.  Mandich started talking with other dentists and cloned the Angels Touch web page using Dr Peña’s name and picture to attract and deceive patients and take their money.  He also fraudulently sold franchises of Angels Touch Dental in Cancun, Mazatlan and Puerto Vallarta, pocketing the franchise fees for himself.  Complaints came to Dr Peña’s  office and that is how she found out about the fraud being committed by David Mandich and Dr. Ramirez Cabañas.

Following this, the arrest warrant was put out for Mandich and Cabanas and they were put in jail.  Mandich did not stay in jail long.  In Mexican law there is a legal instrument called an amparo which protects your freedom and rights during the legal process.  This allows the accused to be free from jail while awaiting the judgment.  Mandich used the amparo to get himself out of jail and then promptly escaped from Mexico.  His whereabouts are currently unknown.  Two of the websites used by David Mandich are http://www.aboutmexicandentists.com and http://www.angelstouchdentalclinic.com.

It appears Mandich is still continuing his fraudulent and utterly baseless campaign as evidenced by this recent blog post on January 5^th of 2012.  Below is a copy of this post found on the internet.  Again, all of the allegations against Dr. Pena in this blog are untrue.

A dumbbell formed by an American writer David Robert Mandich and a dentist from Puebla became the new host in Los Cabos Jail accused of fraud, specifically of having used the name without authorization, logos, images and documents of the company Angel Touch Dental Clinic for own benefit, legal and intellectual property which have never demonstrated to the authorities.

And is that the writer David Robert Mandich, an American 63-year-old with registered offices at Paseo de Los Cabos, number 115 in Cabo Bello and Rafael Ramirez Cabanas, a dentist from Puebla 59-year-old resident in the street Camino Viejo a San José, Department No. 01, Building “F”, in Colonia El Medano began to profit from the corporate image, information, documentation and even the name of the entity S. Angel Touch Dental Clinics of R.L. de CV apocryphally, as the rightful owners of the mark, registered since 2006 to the appropriate authorities and recognized as a society to the Foreign Ministry never gave this pair of subjects the use of his image, prompting the complaint for fraud now keeps behind the bars of a cell in the southern Jail.

Maybe you need to consider this before you make bussines with this guy:

• He is not in Mexico
• He have several serach warns by Mexican police
• He is not a dentist
• He always uses IP phones for his business, there is no way to track where is
• He use websites and blogs to defame their competitors
• He is anangry  lonely ex-husband taking revenge

In the Mexican law there is a legal instrument that calls Amparo, that means if you have an arrest order you do an amparo, and the law protect your freedom rights. (You don’t go to jail during the process of the court).

So if I want to put you in jail you don’t need to know there is an arrest order, because you will get an amparo.

Mr. Mandich is telling me and to the entire world by internet that he have an arrest order against me, I think if he wants me on jail he don’t need to say nothing to no body so I cannot get an amparo.

But he is telling everybody because this arrest order is faked by him.

I went to the federal court and …surprise they told me there is no arrest order against my person.

Here I present the document with the date November 25th 2011. The fake arrest order is from January 13th 2011.

That means my document is actually the good one.

He is using several websites to promote his fraudulent companies, in this websites you will find spectacular and almost free vacations in Los Cabos to make you a dental work or any cosmetic surgery.

Do not be fooled by this person is like a timeshare salesman who always have many unpleasant surprises at the end of each treatment.
